Chief Compliance Officer (m/f/d)
As Chief Compliance Officer, you are responsible in monitoring and evaluating the adequacy and effectiveness of the measures, policies and procedures put in place to achieve the objectives, as well as the steps taken to address any deficiencies in the Company's compliance with its obligations at the Luxembourg office.
- Lead, coordinate and further develop the Compliance team, including the allocation of responsibilities, supervision of deliverables, quality assurance, training and performance development
- Assume overall responsibility for the design, governance and continuous enhancement of the Luxembourg Compliance and AML/CFT framework, including the appropriate allocation of responsibilities between the management body, Compliance and other control functions
- Act as, or support the appointment of, the relevant Luxembourg AML/CFT officer roles, including the RC and, where applicable, the RR, in line with applicable regulatory requirements and governance arrangements
- Develop and maintain a risk-based Compliance and AML/CFT programme covering the AIFM, the Luxembourg office and, where applicable, the funds and investment vehicles managed or overseen by the AIFM
- Oversee day-to-day Compliance, AML/CFT and KYC activities, including name screening, customer and counterparty due diligence, database maintenance and the use of relevant systems such as LexisNexis
- Lead and coordinate the Business Risk Acceptance Committee, including the preparation of risk assessments, recommendations, decision records and related documentation
- Develop, review and maintain Compliance and AML/CFT policies, procedures, guidelines and controls, and ensure their approval by the relevant governance bodies
- Monitor regulatory developments and oversee compliance with applicable requirements relating to AML/CFT, KYC, fraud prevention, conflicts of interest, personal transactions, market conduct, investor protection, complaints, outsourcing and delegated activities
- Oversee the identification, assessment, documentation, escalation and remediation of Compliance and AML/CFT risks, breaches, incidents and control deficiencies, including the handling and, where appropriate, submission of suspicious activity reports via GoAML
- Act as the central point of contact for Compliance and AML/CFT matters in dealings with the CSSF, the FIU, auditors, consultants, delegates and other relevant external stakeholders
- Coordinate regulatory inspections, internal and external audits and due diligence reviews, and ensure the timely remediation of resulting findings
- Take overall responsibility for complex RC mandates and oversee the quality and proper execution of standard RC mandates, where applicable
- Provide independent, pragmatic and risk-based Compliance and AML/CFT advice to senior management, employees and governance bodies
- Ensure that the Compliance function has appropriate resources, expertise, systems, reporting lines and independence, and lead its further development, including quality assurance and training
- Promote a strong culture of compliance, integrity and effective risk management across the organisation
- Extensive experience in Compliance, AML/CFT and KYC within the financial services industry, preferably in an AIFM, management company or another regulated environment
- Proven experience in a senior Compliance, AML/CFT or RC role, ideally with responsibility for a regulated entity or significant business area
- In-depth knowledge of Luxembourg and EU regulatory requirements relating to Compliance, AML/CFT, KYC, AIFM and investment fund activities, including the CSSF supervisory environment and FIU reporting requirements
- Experience in developing and implementing risk-based Compliance monitoring programmes, internal controls and remediation processes
- Strong understanding of governance structures, the three-lines-of-defense model, outsourcing and delegation arrangements
- Experience in dealing confidently with regulators, auditors, senior management, governing bodies and other internal and external stakeholders
- Good knowledge of AML/KYC systems, screening tools and relevant regulatory technology solutions, combined with strong IT skills
- Very good command of German and English, both written and spoken
- Excellent organisational and prioritisation skills, sound judgement and a structured, independent and accountable approach to work
- Strong leadership, communication and stakeholder-management skills, with the ability to further develop the Compliance function and promote a strong culture of compliance and risk awareness
